Trademarks and Intellectual Property Marking Guidelines

Interactive Intelligence Inc. is the owner of valuable rights in patent, trademark, copyright, trade secret and other forms of Intellectual Property ("IP") protection. It is important to ensure that proper steps are taken to identify and protect these IP rights. Also, proper marking of these IP rights provides legal notice to others, which enhances the rights and remedies available to Interactive Intelligence in any potential dispute.

Trademark Usage & Editorial Guidelines

Trademark Usage Guidelines:
The appropriate trademark symbol (® or ™) should be placed on the right side of a product or application name, preferably on the "shoulder" of the mark. The symbol should always be included when the term is first used in any material, whether on the Web, in a document or otherwise.

Editorial Guidelines:

  • The Interactive Intelligence company name should always be spelled in full (not "ININ" or "I3"). If a shortened version is preferred, please use "the company" following the initial mention of "Interactive Intelligence."
  • All Interactive Intelligence products should be spelled in full on first mention, followed by the abbreviation in parentheses, if appropriate, with applicable trademarks. For example: Customer Interaction Center® (CIC). Following first mention, abbreviated product names can be used (e.g. “CIC”).
  • Any document (print, Web, email) that includes the name of any product/platform/service, must also include a statement that identifies the product/platform/service as having been developed by Interactive Intelligence (this does not include OEM partners).
  • Any document (print, Web, email) that includes the Interactive Intelligence name or logo/graphics, or the name of any product/platform/service and which includes information or contributions from a third party, must include a statement that explains how Interactive Intelligence or its product/platform/service contributes to any joint solution also mentioned in the document.
  • Documents (print, Web, email) prepared by third parties independent of Interactive Intelligence (partners, resellers, consultants, analysts, media, etc.) that include the Interactive Intelligence name or logo/graphics, or the name of any product/platform/service, must be approved by an Interactive Intelligence marketing representative prior to use (see contact information at end of this page).

Copyrights
Copyright protection applies to all original and creative works authored by Interactive Intelligence, Inc. This includes software, software/product documentation, internal business documents, and informational literature. In addition to copyright placements on software (see guidelines below), other examples of where a copyright notice should be used include:

  • Brochures/collateral sales and marketing materials
  • CBT demos
  • Contract proposals/presentations
  • Documentation (online and printed)
  • E-mail announcements (e.g., external "info blasts")
  • Educational materials
  • Fax cover sheets
  • PowerPoint presentations
  • Press releases
  • Web-based publications
  • White papers

A copyright notice should be applied to all such works upon creation, even if the work is not yet registered with the U.S. Copyright Office. The proper form of notice includes the:

  1. Word "Copyright" and/or the "©" symbol,
  2. Year(s) when the work and any variations were first published, and
  3. Corporate name, Interactive Intelligence, Inc.

Any of the following variations would be an appropriate form of notice:

Copyright © 1996, 1998-2008, Interactive Intelligence, Inc.

The copyright notice should appear in a visible location where a user of the material would expect to find it, such as the header or footer of a document or presentation. The notice should be easy to find without being "blatant."

Copyright placement on software

For software, the copyright notice should appear on one or more user (splash) screens and in a remark statement in the source code. The software media should include the notice on the label of the media itself (e.g., diskette, CD-ROM, tape, etc.), and on any packaging and other materials associated with the media.

Patents
Interactive Intelligence has a number of U.S. and foreign patent applications pending. These applications relate to various Interactive Intelligence products or product features, particularly regarding Enterprise Interaction Center (EIC), the Interactive Intelligence Customer Interaction Center (CIC), Service Interaction Center (SIC) and e-FAQ. These applications reflect the new and creative solutions available with Interactive Intelligence's products. It therefore is appropriate to identify such software products with the designation: "U.S. and Foreign Patents Pending."

Marking for Third Party Intellectual Property (IP) Rights
When referencing products from other companies, such as Microsoft Corporation, only referenced products need be included in the IP notice. For example, if referencing only Windows® 2000, the notice would indicate: "Microsoft® and Windows® 2000 are registered trademarks of Microsoft Corporation." A further example of an appropriate third party IP notice is as follows:

Microsoft®, Windows®, Windows® 95, Windows® 98, Windows NT®, Windows® 2000, Windows® 2003 and Windows® XP are registered trademarks of Microsoft Corporation. Other brand and/or product names are trademarks or registered trademarks of their respective companies.

Third Party Obligations Regarding IP Rights of Interactive Intelligence
Resellers, OEMs, end users and other third parties are expected to comply with proper use of notices for the IP rights of Interactive Intelligence, Inc. Copyright notices are not authorized to be removed from any materials of Interactive Intelligence, except when authorized by written agreement. Specifically, other parties shall not remove or alter patent, trademark or copyright notices contained in or on INTERACTIVE INTELLIGENCE software, media, publications, etc.

OEM partners may be permitted by written consent to remove certain IP notices, provided that an authorized notice is substituted, and/or that at least one Interactive Intelligence patent and copyright notice, properly located, is retained on each item.
